Misclassified workers can now be found in almost every sector of the economy, working for small companies to publicly traded multinational corporations. The ramifications of misclassifying employees as independent contractors are significant. Employers could be liable for unpaid payroll taxes, claims based on denial of employees’ participation in benefit plans, and possible out-of-pocket liability for workplace injuries due to the lack of a workers’ compensation insurance policy. Regardless of whatever traditional “test” is used on state or federal level to determine the classification of a person, one thing is certain today – IT IS MORE

COMPLICATED THAN EVER.

NAPS provides solutions for companies and contractors to ensure the risk associated from misclassification is reduced. NAPS designed a unique solution to relieve administrative burden, develop efficiency, eliminate insurance exposure, and preempt possible legal issues.

Transportation Industry

Independent owner-operators have long been an important component of virtually every segment of the trucking industry. They are used in most, if not all, sectors of the trucking industry, including long-haul trucking, household goods moving, and intermodal operations. The reasons that independent contracting is attractive to both motor carriers and owner-operators are clear.

For trucking companies, independent contractor/owner-operators provide a number of advantages. Independent owner-operators often are mature drivers who are highly skilled and motivated. The availability of such owner-operators and their equipment (through leases of equipment to carriers with operating authority) enables trucking companies to save on equipment and capital costs and provides flexibility to meet fluctuations in demand for trucking services. In addition, owner-operators and other independent contractors typically share the trucking companies’ interests in meeting customer demand and increasing revenues and profits. In short, many trucking companies believe owner-operator/independent contractors to be more productive, dedicated, and safety conscious than employee drivers.
